Sweepstakes Official Rules
Eligibility:
The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia, or Canada (collectively, the “US or Canada”) who are 18 years of age or older, are located in the US or Canada at the time of entry and have received an email invitation to participate in the Sweepstakes from Invoca, Inc. (“Invoca”). You may not participate in this Sweepstakes (i) if you are not a legal resident of the US or Canada or (ii) if you are an employee of Invoca. This Sweepstakes is subject to all applicable laws, rules and regulations and is void where prohibited or restricted by law.
Entry Period:
The Sweepstakes begins at 12:00 a.m. Pacific Standard Time (“PST”) on April 15, 2024 and ends at 11:59 p.m. PST on June 7, 2024.
How to Enter:
To enter the Sweepstakes, follow the link in the invitation email provided by Invoca to register. The winner must meet the eligibility requirements set forth in these Official Rules in order to qualify for the prize. Limit one entry per person, per email address. You may not enter more than once using multiple email addresses, false identities, or any other methods in an attempt to circumvent the rules.
If the Sweepstakes is not capable of running as planned, due to any computer viruses, bugs, tampering, unauthorized intervention, fraud, security issues, technical failures, or such other factors beyond the control of Invoca, Invoca reserves the right to, at any time and without prior notice, suspend, terminate or modify Sweepstakes in any way (in whole or in part), and Invoca may select winners from all eligible entries.
Selection of Winners:
Winners will be determined by a random drawing from all eligible entries received throughout the entry period and will be notified at the email address provided. By accepting the Prize, the winner consents to Invoca’s use of winner’s name, photograph, voice, statements and/or likeness, in any and all media worldwide now known or developed for Invoca’s legitimate business purpose, including but not limited to, advertising or promotion without further compensation, unless prohibited by law. The winner’s receipt of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations.
Odds:
The odds of winning will depend upon the actual number of eligible entries received for this Sweepstakes
Prize:
The winner of this Sweepstakes will receive a retro handheld game console with pre-loaded games (“Prize”). The total Approximate Retail Value (“ARV”) of the Prize available in this Sweepstakes is $57 USD. No substitution, cash redemption, transfer of prizes or equivalent is permitted. Any and all expenses related to the Prize, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of winner. The winner must contact Invoca within 3 business days from the date of notification by Invoca to claim the Prize. Any winner notification not responded to may result in Prize forfeiture and a new winner will be selected. If the advertised Prize cannot be awarded for any reason, Invoca reserves the right to substitute a Prize of equal or greater value. Invoca makes no representation or warranties concerning the appearance, safety or performance of the Prize awarded.
General Rules:
By participating in this Sweepstakes, you agree to abide by and be bound by these Official Rules. You agree to release, discharge and hold harmless Invoca from and against any and all liability, loss, injuries or damages associated with participation in this Sweepstakes or the acceptance, possession, use or misuse of any Prize received in this Sweepstakes. You agree to waive all rights to claim punitive, indirect, incidental and consequential damages, or attorneys’ fees arising out of or related to this Sweepstakes. All applicable federal, state and local laws apply.
Governing Law:
All issues, disputes, claims and causes of action arising out of or connected to this Sweepstakes, will be governed by, and construed in accordance with the laws of the state of California, without regard to the principles of conflict of laws thereof. If any part of these Official Rules is determined to be invalid or unenforceable by a court of competent jurisdiction or by any other legal body having jurisdiction to make such determination, the remainder of these Official Rules shall remain in full force and effect. The parties agree and accept that all such disputes/claims will be resolved by means of a court trial conducted by the superior or district court in Santa Clara County, California.
Privacy:
Invoca will be collecting personal information about you in accordance with its Privacy Policy located at http://www.invoca.com/privacy-policy/. By participating in the Sweepstakes, you hereby agree to Invoca’s collection and usage of your personal information and acknowledge that you have read and accepted Invoca’s Privacy Policy.
Marketing:
By participating in the Sweepstakes, you are consenting to be contacted by Invoca for the Sweepstakes and for future marketing purposes, unless you otherwise revoke such consent.
